Avoital — Service Terms

Working draft · Effective when formally published/accepted · hello@avoital.com

Review-stage notice: This is Avoital's approved working business draft, pending legal review. It should be confirmed against actual payment, refund, privacy and delivery operations before public use.

1. About Our Services

Avoital provides clinical-content adaptation and patient-communication design services for healthcare professionals and practices.

We convert clinician-provided explanations or approved educational material into formats such as Patient Handouts, Patient FAQs, Educational Visuals & Carousels, and multi-asset content bundles.

Avoital is a content-production service, not a healthcare provider or independent clinical-review service.

2. Service Scope and Deliverables

The agreed product, topic, language, format, number of assets, price, and delivery timeline will be confirmed before work begins.

Our current introductory offerings include:

These are introductory prices and may change for future engagements. Any additional requirements will be discussed and quoted separately.

Website samples demonstrate design and presentation possibilities. They do not represent clinically certified material or guaranteed outcomes.

3. Information Provided by the Client

Clients should provide a clinical topic through a short voice note, approved text, or other authorized educational source, together with the relevant clinic-branding information.

Clients are responsible for ensuring they have permission to share the supplied material.

Please do not submit patient names, medical-record numbers, identifiable case details, or other patient-sensitive information. If such information is received unintentionally, Avoital may pause processing and request a de-identified replacement.

4. Clinical Accuracy and Approval

Avoital performs editorial, structural, readability, and design checks within the agreed scope.

We do not independently diagnose patients, prescribe treatment, or certify the clinical accuracy of materials.

The treating clinician is responsible for reviewing and approving the final clinical wording, medical illustrations, warnings, and intended use before publication or distribution to patients.

Avoital may flag unclear statements or potential inconsistencies for clarification.

Client approval confirms that the client has reviewed the deliverables for their intended clinical and professional context.

5. AI-Assisted Production

Avoital may use AI-assisted writing, editing, layout, and graphic-design tools as part of its production process.

All content remains subject to editorial checks and the clinician-approval requirements described above.

AI-generated anatomical illustrations, medical diagrams, or clinically consequential visuals should not be treated as verified medical references without appropriate review.

Avoital will not knowingly fabricate doctor credentials, endorsements, patient testimonials, or treatment outcomes.

6. Revisions and Delivery

One consolidated revision is included in each engagement unless otherwise agreed in writing.

Revision requests should relate to the original approved topic and scope. New topics, additional content formats, extensive restructuring, or repeated revisions may require an additional quotation.

Delivery timelines begin after Avoital receives sufficient source material, branding details, and the agreed payment or payment confirmation.

Turnaround estimates may change if clarification, specialized graphic work, or language review is required.

A delivered draft must not be considered clinically approved merely because no revision has been requested.

7. Languages and QR Codes

Marathi or Hindi adaptation of the same English Patient Handout is available at an introductory charge of ₹500 per additional language, subject to the necessary language and clinical-meaning checks.

FAQ and carousel translations are quoted separately.

Optional QR codes may link to a client-approved online document or resource. The client must provide or approve a suitable destination URL.

Website hosting, ongoing link maintenance, content updates, and third-party platform charges are not included unless expressly agreed.

8. Fees and Payment

Fees, applicable taxes, payment milestones, and any additional charges will be confirmed before an engagement begins.

Payment arrangements will be communicated through Avoital’s authorized email or other agreed business communication channel.

Services outside the agreed scope will not be charged without prior client approval.

9. Cancellations and Refunds

If the client cancels before production begins, payments received for unstarted work will be refunded, subject to any previously disclosed, nonrecoverable third-party expenses and applicable law.

If cancellation occurs after production begins, Avoital will identify the work completed and discuss an appropriate settlement or refund for the undelivered portion.

If Avoital cannot deliver the agreed scope, we will offer a reasonable correction, revised delivery arrangement, or refund for the affected undelivered work, as appropriate.

Nothing in these terms limits rights or remedies that cannot legally be excluded.

10. Ownership and Usage Rights

The client retains ownership of the original explanations, branding, photographs, logos, and other materials they provide.

After full payment, the client receives a continuing, non-exclusive right to use, reproduce, modify, and distribute the finalized deliverables for their own clinic’s educational and professional communication purposes, subject to applicable third-party licensing restrictions.

Avoital retains its pre-existing templates, production methods, reusable design components, and general workflows.

Resale of deliverables as standalone templates or products, exclusive ownership arrangements, and transfer of source design files require separate written agreement.

Avoital will not publicly identify a client or display client-specific commissioned work as a portfolio example without the client’s permission.

11. Privacy and Information Handling

Avoital seeks to minimize the personal information collected for production.

Source recordings and working clinical materials will be handled with restricted access and are intended to be deleted within 14 business days after engagement completion or cancellation, unless longer retention is legally required or separately agreed.

Certain administrative records, such as invoices and payment correspondence, may need to be retained for legitimate business or legal purposes.

Further details about collection, processing, service providers, security, and retention will be provided in Avoital’s Privacy Policy.

12. Professional and Platform Guidelines

Avoital aims to develop factual, informative patient-education content and avoid misleading, exaggerated, or inappropriate promotional claims.

Healthcare professionals remain responsible for ensuring that final publication and distribution comply with applicable professional, regulatory, advertising, and platform requirements.

Avoital does not guarantee regulatory approval, particular patient outcomes, search rankings, social-media engagement, or business growth.

13. Changes and Communication

Any material changes to an active engagement’s agreed scope, fees, or delivery arrangements will be discussed with the client before implementation.

General website service terms may be updated prospectively. The terms and agreed scope confirmed for an existing order will govern that order unless both parties agree otherwise.
